The petition to cancel the FIR filed by Bollywood actor Aditya Pancholi in the rape case was heard today in the Bombay High Court for the 28th time. Bollywood actors reached Bombay High Court today. In this matter, Aditya Pancholi said that this case is going to be canceled, this matter is pending in the court, cannot say anything else on this and what will happen next in this will be known on March 4.
What did Aditya Pancholi’s lawyer say?
The complainant in this case is a female actress and the accused is Aditya Pancholi. Pancholi’s lawyer Prashant Patil said that the demand for cancellation of the FIR of rape (IPC 376 and other sections) registered in Versova Police Station in the year 2019 has been reiterated. The next hearing of the case has been fixed for March 4. Patil said that while presenting the police’s side in the court, the public prosecutor said that despite the police sending notices 11 times, the victim did not appear for the investigation. After this, the High Court has again issued notice today and directed to appear on the next date.
Supreme Court’s ‘Bhajanlal’ decision was cited in the petition
It is noteworthy that there has been controversy regarding this FIR registered on June 27, 2019. The accused party claims that the complaint was filed almost 15 years after the alleged incident and this action is malicious. In the petition, citing ‘Bhajanlal’ decision of the Supreme Court, a demand has been made to cancel the FIR.
Patil told that before the FIR was registered, some person had met Aditya Pancholi, the recording of which we have, we have presented that recording in the court and explained how the intention behind registering this FIR is wrong and why it should be cancelled. Today, a lawyer appeared in the court on behalf of the complainant and asked for time from the court and said that he needs time in this matter so that he can take instructions from his client and present his side.
The case is currently pending in the court and the next hearing will be on March 4.
