The Central Bureau of Investigation (CBI) has challenged the Delhi High Court’s decision in the Unnao rape case in the Supreme Court. CBI has requested the Supreme Court to reconsider the High Court’s order suspending the sentence and granting bail.
Kuldeep Singh Sengar was sentenced to life imprisonment and a fine of Rs 25 lakh in December 2019. He had filed an appeal against this in the Delhi High Court in January 2020. After this, a petition for sentence suspension was also filed in March 2022. This petition was strongly opposed by the CBI and the lawyers on behalf of the victim.
High Court suspended Sengar’s sentence
After hearing all the arguments, the Delhi High Court suspended Sengar’s sentence till the disposal of the appeal on 23 December 2025 and granted him bail with certain conditions. However, despite the relief, Sengar will not be able to come out of jail at the moment, because he is serving a 10-year sentence for murder in another CBI case. After studying this order of Delhi High Court, CBI has filed a special leave petition in the Supreme Court on 26 December 2025 challenging this decision.
