Actually, former CJI Dhananjay Yashwant Chandrachud (DY Chandrachud) participated in the Literature Festival organized in Jaipur, the capital of Rajasthan on Sunday (January 18, 2026). Where he was questioned about the rejection of bail of activist Omar Khalid, the main accused in the Delhi riots of 2020.
On this, the former Chief Justice said that bail before conviction should be a fundamental right. However, he also clarified that in cases related to national security, it is the duty of the court to investigate the case thoroughly before granting bail.

He said, ‘Our law is based on the presumption of innocence. No person will be considered guilty until his guilt is proven. He further said, ‘If a person remains in jail for five or seven years and is later proven innocent, how will his lost time be compensated?’
SC heard the petition of Delhi riots accused
The Supreme Court had recently heard the bail plea of ​​7 accused in the 2020 Delhi riots. After the hearing, the Supreme Court granted bail to five of the seven accused, while canceled the bail of two accused Umar Khalid and Sharjeel Imam.
The Supreme Court bench of Justice Arvind Kumar and Justice NV Anjaria said on January 5, 2026 that Article 21 (right to life) of the Constitution is important, but this right is not beyond the legal provisions.
