A reply has been filed in the Rouse Avenue Court on the revision petition filed against Congress Parliamentary Party President Sonia Gandhi in the case of inclusion of her name in the voter list by alleged fraud without acquiring citizenship.
In her reply filed in the court, Sonia Gandhi said that this petition has been filed on a completely wrong basis and its purpose is only to take political advantage. In the reply filed in the court, it has been clearly stated that the Central Government has the jurisdiction over matters related to citizenship, while the disputes related to the voter list come under the jurisdiction of the Election Commission.
‘Allegations based only on conjecture and imagination’
On behalf of the Congress leader, it was said that interference of criminal courts in such cases is prohibited under Article 329 of the Constitution. On behalf of Sonia Gandhi, it was said that the allegations made in the complaint are based only on conjecture and imagination. The complainant could not even clarify which documents were allegedly forged, when they were made and by whom. Neither a copy of any application was produced nor was it stated that any legal effort was made to obtain any such document.
The court was told that the incidents on which the complaint is based are said to be of the period 1980–83. After such a long time, neither reliable evidence can be found nor is it legally appropriate to pursue such cases. Sonia Gandhi said that raising allegations that are more than 40 years old is a violation of the fundamental rights of a person.
It has also been said in the reply that the complainant has tried to build a case on the basis of media reports and old newspaper clippings, which have no legal significance. On one document, the word National Capital Territory of Delhi was mentioned to be used, whereas this word came into use after 1991, which raises questions about the authenticity of that document.

Apart from this, the court was also told that as per the law, it is mandatory to have a properly verified affidavit along with the petition filed under Section 175(3), which is not present in this case. In such a situation, the Magistrate has no right to hear this complaint. Sonia Gandhi demanded from the court that this criminal revision petition should be dismissed, as it is not only an abuse of law but is also baseless and malicious. Rouse Avenue Court will hear the case next on February 21.
