Former judge of Madhya Pradesh High Court, Justice K.K. Trivedi on Monday (December 15, 2025) claimed that the opposition parties had appointed Justice G.R. of Madras High Court for political purposes. An impeachment motion has been presented against Swaminathan and this is an attempt to create pressure and get a decision in favor of a particular party.
Recently, the opposition has submitted a notice to Lok Sabha Speaker Om Birla to bring an impeachment motion against Justice Swaminathan on charges of alleged misconduct. This notice has been signed by 107 MPs from various parties including Congress, Dravida Munnetra Kazhagam (DMK) and Samajwadi Party.
MPs have alleged that Justice Swaminathan’s work has raised questions on the impartiality, transparency and secular nature of the judiciary. This impeachment motion is against his decision on the issue of lighting the Karthigai Deepam at Tiruparankundram hill in Madurai.
After this notice from the opposition, about 56 former judges of the Supreme Court and various High Courts issued an open letter opposing the impeachment motion, saying that this step is an attempt to create political and ideological pressure on the judges and to intimidate them.
Former Justice KK Trivedi, who signed this letter, told PTI Video, ‘We are all unanimous that the kind of action taken is completely wrong, especially when the matter concerned is still pending before the court.’ He said that this step cannot have any positive purpose. He said, ‘Either this action has been taken only for political purposes or there is an attempt to put pressure on the judge to get a decision in favor of a particular party.’
He clarified that both the situations are not acceptable under any circumstances as it causes serious damage to the reputation of the entire judiciary and the Indian judicial system and also weakens the trust of the people. The former judge said that there are clear provisions in the Constitution for the way impeachment is being talked about against judges.
He said that there is a provision in the provisions of the Constitution that a proposal to remove a judge from the post can be brought only on the basis of proven misconduct or incompetence. He raised the question that how can an impeachment motion be brought on the basis of things which are not valid in law.
He said, ‘This entire step appears to be an attempt to interfere in the judicial process and can also be seen as an attempt to put pressure on the judge.’ The former judge said that every person should look at himself before pointing fingers at others.
He asked, ‘Are the people who have presented this impeachment motion clean in every way? If not, then how do they have the moral right to take such a step? The ruling Bharatiya Janata Party (BJP) has also described this move of the opposition as an attempt to show anti-Hindu sentiments as well as an insult to the independence of the judiciary.
