Justice Yashwant Verma, caught in the cash scandal, challenged to form an investigation committee, SC said – how is this wrong?

While hearing the petition of Justice Yashwant Verma implicated in the cash scandal on Wednesday (January 7, 2026), the Supreme Court said that how can the decision taken by the Speaker of the Lok Sabha to form a committee be wrong. Justice Verma has challenged the formation of an inquiry committee on behalf of the Lok Sabha Speaker. He says that notice was given in Rajya Sabha and Lok Sabha on the same day on 21st July. In such a situation, a House could not form a committee.

Last month, the court had sought answers from the Lok Sabha and Rajya Sabha secretariat on this. During the hearing, the court said, ‘On July 21, notice was given in both the Houses, but on August 11, the Deputy Chairman of Rajya Sabha rejected it. In such a situation, how can the formation of a committee by the Lok Sabha Speaker on August 12 be called wrong?

Senior advocate Mukul Rohatgi, appearing for Justice Verma, accepted that there is no clarity in the law regarding this. Rohatgi says that the Chairman of Rajya Sabha had resigned. The Deputy Chairman should not have taken the decision to reject the notice.
