How to respond to Legal Message: If you have recently received a summon related to any legal matter on WhatsApp or email and you are thinking of ignoring it considering it to be fake, then be careful. Uttarakhand High Court has officially implemented the system that summons in check bounce cases can now be sent through digital means also. This means that the notice received through WhatsApp and email can be completely legal and valid.
What has changed in the court procedure
According to the circular issued by the Registrar General of Uttarakhand High Court, now only traditional methods will not be relied upon to give summons in check bounce cases. Under Uttarakhand Electronic Process Rules 2025, summons can also be sent through email, mobile number and messaging platforms like WhatsApp. Its purpose is to make the process fast and effective.
What is required while filing a complaint
Now when a person files a check bounce complaint, it will be mandatory for him to provide the email ID and WhatsApp number of the accused. Along with this, an affidavit will also have to be given in which it will be confirmed that the information given is correct and authentic. The court will issue digital summons only on the basis of this information.
Case processing will be easier
Under the new system, a brief description in the prescribed format will be attached with every complaint which the court staff will enter in the judicial computer system. The special thing is that now no additional process will be required under Section 223 of BNNS before sending summons to the accused, which will reduce the delay in hearing the cases.
Automatic monitoring will be done through technology
A new draft template has been added to the court software that will automatically calculate the limitation period related to the “cause of action” in the case. This will reduce the possibility of technical mistakes and tracking of cases will be more accurate.
You can get quick solution through online payment
A big advantage of this new system is that now the facility of online payment is also being given to the accused. There will be a direct payment link in the summons, where the accused can deposit the check amount by entering the CNR number or case details. If the payment is successful then the court can exercise the right to close the case on the basis of mutual agreement.
Effect of Supreme Court’s instructions
These instructions of the High Court have been issued after the recent decision of the Supreme Court in which it was said that lakhs of pending check bounce cases across the country are putting huge pressure on the justice system. Digital summons and online settlement are being considered as the solution to this problem.
Strict action against giving wrong information
The court has clearly warned that if wrong email or WhatsApp information is deliberately given while filing the complaint, then strict legal action can be taken against the person concerned. Therefore, transparency and responsibility are very important in this new system.
