The Supreme Court has disposed of the petition filed against the film ‘Ghooskhor Pandit’. The court also said that there should be no further legal dispute regarding this matter. This was done after the assurance given by the producer that no class has been insulted in this film, the name over which there was controversy has also been withdrawn.
In the last hearing held on February 12, the Supreme Court had strongly reprimanded the producer. The court had said that in the name of freedom of expression, it cannot be allowed to insult any class or harm social brotherhood. While issuing notice to the producer, the court had asked what he was going to change the name of the film to.
Objections regarding the film were raised in the petition filed by Atul Mishra, secretary of an organization named Brahmin Samaj of India. The lawyer appearing for the film’s producer Neeraj Pandey had told the Supreme Court that the Delhi High Court had also heard some petitions regarding this matter. The producer is ready to change the name of the film.
These questions were asked in the affidavit
However, the bench of Justices BV Nagarathna and Ujjwal Bhuiyan was not satisfied with this argument of the manufacturer. Justice Nagarathna had said, “First tell us what you are going to change the name to? You should also give an affidavit telling us whether there is anything objectionable about any class in your film or not?”
After this, Justice Nagarathna had said, “The Constitution has given freedom of expression. But it is wrong to insult any class.” Now the producer has said that he does not want to give any argument regarding freedom of expression. He respects the concerns expressed by the petitioner and is ready to make necessary improvements.
On behalf of the film producer, it was said that he has withdrawn the controversial name. The new name has not been decided yet. The publicity related to the old name has been removed from everywhere. The producer also said that no class has been insulted in the film. People call the main character of the story as ‘Pandat’. Taking the producer’s arguments on record, the court settled the case.
