The Supreme Court agreed to hear on Wednesday (February 11, 2026) the petition of the Uttar Pradesh government, in which a decision of the Allahabad High Court has been challenged. In this decision, the death sentence of four accused and the life sentence of another in the 2007 Rampur CRPF camp terrorist attack case were cancelled.
Eight CRPF soldiers were killed and five were injured in the attack on the Central Reserve Police Force (CRPF) camp located in Rampur on the night of 31 December 2007. The bench of Justice Vikram Nath and Justice Sandeep Mehta issued notices to the accused on the petition of the state government and scheduled the hearing of the case after four weeks.
Advocate MS Khan appeared on behalf of the five accused. The state government has challenged the decision given by the High Court on October 29 last year. The High Court had rejected the order of the lower court, in which four people were sentenced to death and another to life imprisonment in this case.
The High Court had acquitted Mohammad Sharif, Sabauddin, Imran Shahzad, Mohammad Farooq and Jang Bahadur Khan of murder and other serious charges, saying the prosecution had failed to prove beyond reasonable doubt the case of the main crime against the accused. However, the court found all five, including Jung Bahadur Khan, guilty under Section 25 (1-A) of the Arms Act and sentenced them to 10 years of rigorous imprisonment. Jang Bahadur Khan was sentenced to life imprisonment.
The High Court had said, ‘Before disposing of the case, we would certainly like to mention that if the investigation and prosecution had been done by a more trained police, the outcome of this case would have been different.’ The court had said that due to shortcomings in the investigation the accused were ultimately acquitted.
The High Court had said, ‘Mohammad Sharif; Sabauddin; Imran Shahzad and Mohammad Farooq were sentenced to death under Section 302 read with Section 149 of the Indian Penal Code (IPC) and a fine of Rs 50,000 each was imposed on each convict. All of them have been acquitted of the charges leveled against them.
The court said, ‘Jang Bahadur Khan, who was sentenced to life imprisonment under section 302 read with section 149 of the IPC and a fine of Rs 50,000, has also been acquitted.’ The High Court had imposed a fine of Rs 1 lakh each on the five convicts for the offense committed under the Arms Act. The accused had filed an appeal in the High Court against the decisions passed by the Additional District and Sessions Judge of Rampur on November 1, 2019 and November 2, 2019.
