The Supreme Court has rejected the petition challenging the tradition of sending chadar by the Government of India to Ajmer Sharif Dargah. The bench headed by Chief Justice Surya Kant said, ‘This is not a matter on which a court hearing is necessary.’
In this case, the door of the Supreme Court was knocked by Vishwa Vedic Sanatan Sangh chief Jitendra Singh Bisen and Hindu Sena president Vishnu Gupta. He said that offering chadar at the Dargah by people holding constitutional posts is against the principle of government neutrality. The petitioners had sought to stop Prime Minister Narendra Modi from presenting the chadar during the 814th Urs of Sufi saint Khwaja Moinuddin Chishti.
The bench of Chief Justice Surya Kant and Justice Joymalya Bagchi refused to hear the case. He said that this is not an issue on which the court should give a decision. The judges also said that since the sheet has been presented this year, the case has become meaningless.
During the hearing, the Supreme Court noted that a case claiming Ajmer Sharif Dargah as a Hindu temple is pending in the civil court of Ajmer. The judges made it clear that their order will not affect the case. The Chief Justice said, ‘The case is pending, take it forward. This order will not have any effect on him.
Keep in mind that the tradition of presenting a chadar on behalf of the Prime Minister at Ajmer Dargah has been going on for a long time. The present government is also following this. The petitioners had said that Ajmer Sharif Dargah was built on the site of a demolished Shiva temple. Its case is pending in the lower court. In such a situation, sending a sheet by the government on that ‘disputed structure’ can affect the fair hearing.
