Actor and entrepreneur Vivek Oberoi has filed an important petition in the Delhi High Court regarding the protection of his personality rights. In this petition, Vivek has demanded from the court that without his permission, no person or organization should be able to use his name, voice, photo or anything related to his identity.
Unknown people are misusing name and identity
In the petition filed in Delhi High Court, Vivek Oberoi has also made John Doe i.e. unknown people as parties. Vivek says that many fake accounts on social media are misusing his name and picture and his identity is being used.
From fake accounts to selling goods
Vivek Oberoi told that some people are using his identity to sell goods without permission. At many places, their pictures are being presented in a wrong and objectionable manner by using Artificial Intelligence and Deepfake technology, which is harmful for their image.
Image being tarnished by videos and posters
Vivek also told the court that his image is being harmed through postcards, posters, videos and posts on social media. Some content is not only misleading but also abusive and defamatory. In many cases, attempts are being made to earn profit in business by taking advantage of their fame and identity.
That person has the first right on name and identity.
It has been clearly stated in the petition that the person has the first right on the name, image and identity of any artist or public figure. No one can use it commercially without his consent. Doing so is legally wrong and harms both the person’s reputation and market value. It is worth noting that even before this, Delhi High Court has protected the personality rights of many famous faces like Pawan Kalyan, former cricketer Sunil Gavaskar, actor R Madhavan, NTR Jr and Salman Khan.
